H-1B visa interview: the questions officers actually ask (2026)

Since September 2025 everyone interviews. The officer is not testing ties: they are testing whether the job is real.

Updated August 2026

The H-1B is a dual-intent visa: INA 214(b) does not apply, and the officer is not testing your ties to home. The real axes are whether the job is real, whether the employer-employee relationship is real, whether you match the petition, and whether anything triggers 221(g) administrative processing: not a denial, but weeks to months of limbo while client chains and documents are verified. Since 2 September 2025 the interview waiver is gone and everyone attends in person, renewals included. This page carries the full question bank with what works and what triggers a 221(g).

This is interview practice, not immigration or legal advice. Merra does not review your petition and does not predict whether your case will be approved or sent to 221(g) administrative processing.

H-1B visa interview FAQs

Does 214(b) apply to H-1B?

No: H-1B is dual intent, refusal-frame is 221(g).

What is a 221(g)?

Administrative processing, not a denial: documents or verification pending, weeks to months.

Who gets 221(g)s?

Overwhelmingly consultancy + client-site cases: know your vendor chain cold.

What about social media?

Under the December 2025 vetting expansion, private profiles are reported to trigger scrutiny: set profiles to public before the interview.

First stamping vs renewal?

Same interview since September 2025: renewals are no longer waived.
